1) Introduction

Welcome to Luxeya. These Terms & Conditions (the “Terms”) govern your access to and use of luxeya.com and any related pages, features, or services (collectively, the “Website”).

References to “Luxeya,” “we,” “us,” or “our” mean Luxeya and its affiliates.

By accessing or using the Website, you agree to these Terms and to all applicable laws. If you do not agree, please do not use the Website.

Arbitration & Class Action Waiver: Disputes must be resolved by binding arbitration on an individual basis. You waive the right to a jury trial and to participate in a class action. See Section 23.

2) Accessibility

3) Authorized Use

The Website and store are for your personal, non-commercial use. Any other use requires our prior written consent.

4) Prohibited Conduct

You agree not to:

  • Use spiders, robots, scraping, data-mining, or automation to copy or manipulate the Website.

  • Overload, disrupt, bypass security, or attempt to gain unauthorized access.

  • Frame or resell access to the Website without permission.

5) Beta Features

We may release features labeled “Beta.” They may be experimental or non-functional. Use at your own risk; we provide no warranties for Beta features.

6) Accounts & Security

Some features may require registration. Provide accurate information and safeguard your passwords/access codes. You’re responsible for all activity under your account. We may suspend or terminate access at any time. See our Privacy Policy for how we handle data.

7) Orders, Pricing & Billing

Our store runs on Shopify. Prices shown at checkout apply on the date we process your order and are in USD, excluding applicable taxes and shipping. You authorize Luxeya or its payment processors to charge your selected payment method.

We may correct pricing or other errors (including after order submission) and cancel or refuse orders where appropriate. You are responsible for complying with all applicable laws related to any purchase.

8) Product Info & Availability

We continually update and refine products. Listing a product does not guarantee availability. We may modify or discontinue products without notice and may substitute items of equal or greater value or cancel orders if an item is unavailable.

9) Accuracy & Corrections

We strive for accuracy but do not warrant that descriptions, images, pricing, or other content are error-free. We may correct errors, update information, revise orders (including charging the correct price), or cancel orders and refund payments.

10) Shipping; Returns & Exchanges

Purchases are subject to our Shipping and Return & Exchange policies posted on the Website. Title and risk of loss pass to you on delivery to the carrier. Please file claims for lost or damaged shipments directly with the carrier.

To request a return or exchange under our policy, contact support@luxeya.com with your order number and details. Decisions are handled case-by-case in our reasonable discretion.

11) Intellectual Property

All content on the Website—including text, graphics, logos, icons, images, software, and design—belongs to Luxeya or our licensors and is protected by intellectual-property laws. You may not copy, modify, distribute, create derivative works, or otherwise use content without express written permission.

12) Your Reviews & Submissions

Where permitted, you may post reviews, photos, or other content (“User Content”) only if you own the rights or have permission. If a person appears, you must have consent (or a parent/guardian’s consent for minors).

You agree to the FTC Endorsement Guides and will disclose any material connection (e.g., discount, gift).

By submitting User Content, you grant Luxeya a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, display, adapt, distribute, and promote such content in any media, without further approval or compensation. You are solely responsible for your submissions.

13) Prohibited Content

Do not post content that is unlawful, defamatory, obscene, hateful, harassing, infringing, misleading, promotes violence or illegal activity, contains malware, or constitutes spam or solicitations.

14) Unsolicited Ideas

We do not accept unsolicited ideas (product, marketing, etc.). If you submit any, you agree they are not confidential and that Luxeya may use them without restriction or obligation.

15) Third-Party Links & Transactions

The Website may link to third-party sites or services we do not control. Review their terms and privacy policies. Transactions with third parties are solely between you and those parties; Luxeya is not responsible for such dealings or warranties.

16) Offers, Promotions & Additional Terms

Promotions, coupons, and special programs may have additional terms. If those terms conflict with these Terms, the additional terms control for that offer.

17) No Warranties; Limitation of Liability

THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, LUXEYA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT THE SITE IS FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUXEYA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, LOSS OF PROFITS, DATA, GOODWILL, OR COVER DAMAGES. IF LIABILITY IS FOUND, OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

California Waiver (CC §1542): If you are a California resident, you waive §1542 as to these Terms.

18) Indemnification

You agree to defend, indemnify, and hold harmless Luxeya and our officers, directors, employees, agents, affiliates, partners, and contractors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Website, your User Content, or your violation of these Terms or applicable law.

19) Changes to These Terms

We may update these Terms at any time by posting the revised version on the Website. Changes apply prospectively. Your continued use after changes means you accept the updated Terms.

20) Severability; Waiver; Cumulative Remedies

If any provision is held invalid, the remainder remains in effect. Our failure to enforce a provision is not a waiver. Our rights and remedies are cumulative.

21) DMCA Notice

If you believe content on the Website infringes your copyright, send a notice including the elements required by 17 U.S.C. §512(c)(3) to support@luxeya.com. We may terminate repeat infringers.

22) International Access

The Website is operated from the United States. You are responsible for compliance with local laws if you access it from outside the U.S.

23) Governing Law; Arbitration; Class Action Waiver; Time Limit

  • Governing Law: The laws of the State of Texas, without regard to conflicts rules.

  • Arbitration: Except for claims eligible for small-claims court, any dispute or claim arising out of or relating to these Terms or your use of the Website will be resolved by binding arbitration administered by the AAA under its Consumer Arbitration Rules.

  • Venue: Unless otherwise agreed, any in-person hearing will occur in Dallas County, Texas or another mutually agreed location.

  • Individual Basis: No class, consolidated, or representative actions. YOU AND LUXEYA WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION.

  • Time Bar: Any claim must be filed within one (1) year after it accrues.

If a court finds the class-action waiver unenforceable, this arbitration clause will not apply and the claim must be brought exclusively in the state or federal courts located in Dallas County, Texas.
